In its judgment of 8 February 2013, LJN BY4889 (Rabohypotheekbank N.V. c.s. / X c.s.) the Supreme Court ruled that a notarial deed, such as a mortgage, only yields an enforcement order within the meaning of art. 430 Rv, if the notarial deed relates to claims which at the time of execution of the deed already existed and are described in the deed, or on future claims that have their immediate basis in one of at the time of execution of the deed already existing and defined legal relationship (compare HR 26 June 1992, NJ 1993/449).
